What is Probate?

Probate is the legal process that gives the Executor of a Will the authority to handle the money, property and personal possessions (the estate) of the person who has died.

Imagine Probate as a legal checkpoint in the journey of a Will. When someone passes away, their will needs a formal "green light" to ensure everything is in order. This process is what we call Probate.

Gaining Grant of Probate serves as the official nod that allows the distribution of assets as per the deceased's wishes. It's like a seal of approval that ensures:

1. Validation of the Will: Confirming that the will is genuine and legally sound.

2. Asset Distribution: Enabling the rightful transfer of assets to beneficiaries.

3. Debt Settlement: Ensuring any debts or taxes owed are paid off appropriately.

We understand that Probate can sound complex and daunting. That's why we offer a fixed-fee, guaranteed Probate service that deals with either just obtaining your Grant of Probate, or the whole Estate Administration & Distribution from start to finish. Get your free quote now.

Frequently Asked Questions

How much does probate cost?

The amount you’ll pay for Probate depends on the type of services you need, and whether the Estate is simple to sort out or has more complexities. At Final Duties, our Probate Experts will examine the details of the Estate in full before providing you with a fixed-fee quote for our services.

How long does probate take?

In most cases, Probate can be completed in around 12-18 months. Various factors will affect how long it takes, including how complicated the Estate is, whether there is any property that needs to be sold and any other specific issues that need to be dealt with.

Who is responsible for obtaining probate?

If there is a Will, the Executors named in the Will are responsible for obtaining Probate and distributing funds to beneficiaries. In cases where there is no Will – or when the Executors of the Will have died or are unable to deal with the Estate – the person who stands to inherit the residuary estate (once all debts and expenses are paid) usually handles the application.

Do you need probate for a small estate?

If the Estate is worth less than £10,000, you may not need to go through Probate. However, you should always check with our Probate experts before moving forward to avoid any potential legal complications.

How many executors can you have in a Will?

Up to four people can be named in a Will to act as Executors. The Grant of Probate will only be issued for up to four people.
